In the Arizona State Legislature, an amendment to the state's budget bill (SB 1035) offered by Senate President Robert Burns would place a moratorium on municipalities adopting building codes and on collecting development impact fees from now until July 1, 2012. Wherever a developer may decide to build, all other taxpayers would be pay the costs of the roads, water lines, sewers, wastewater treatment, and other municipal services to be directed to the area. The amendment, however, does contain language stating which may allow local governments to still comply with ARRA: "This section does not prohibit any code changes to the extent and duration required to comply with conditions for federal stimulus funding."
STATUS: This amendment passed the Senate 16-1. The House's version of the bill passed 32-24 and passed in concurrence in the conference committee. On July 1, Governor Jan Brewer (who is vested with line-item veto powers) vetoed the bill (page 5) in its entirety.
The legislature has been called back to a special session to approve a compromise budget. According to Senate staffers, it is not yet known whether the moratorium language will remain.
